1. Acceptance of Terms

By accessing and using IslandAutoBids, you accept and agree to be bound by the terms and provisions of this agreement.

2. Platform Description

IslandAutoBids is an online listing platform dedicated exclusively to vehicles. Sellers can list vehicles with either fixed pricing or offer-based listings where buyers place competitive offers.

When an offer-based listing ends with a winning offer, we connect the buyer and seller by sharing contact details. We do not facilitate payments or transactions for vehicle sales or mediate disputes. All sales are completed directly between the parties.

IslandAutoBids does not own, possess, inspect, test, certify or sell any vehicle listed on the platform. We are not a party to any sale or other agreement entered into between a buyer and seller.

Unless expressly stated otherwise, we do not independently verify or guarantee the accuracy of vehicle listings or other information provided by users.

3. User Accounts

• Users must be 18 years or older to create an account
• You are responsible for maintaining the confidentiality of your account
• You agree to provide accurate and complete information
• One account per person is permitted
• A verified phone number is required to list vehicles or place offers. Phone verification helps protect the parties involved in a transaction

Phone verification does not constitute a guarantee by IslandAutoBids of a user’s identity, reliability, ownership of a vehicle, authority to sell or the accuracy of a listing.

4. Listing Requirements

• Sellers must have a verified phone number on their account before submitting a listing
• All vehicle listings must be accurate and truthful
• Sellers must have legal ownership or authorisation to sell
• Photos must accurately represent the vehicle's condition
• Any known defects or issues must be disclosed

5. Making Offers and Reserve Prices

• A verified phone number is required before placing any offer
• Offers represent a serious commitment to purchase
• When a listing ends, the highest offer that meets the reserve price is treated by the platform as the winning offer
• Contact details are shared between buyer and seller to complete the transaction directly
• We recommend completing transactions within seven days, but the timeline is between parties
• IslandAutoBids does not guarantee transaction completion

Buyers are responsible for inspecting the vehicle, reviewing the information provided by the seller and carrying out any ownership, registration, finance, mechanical or other checks they consider appropriate before completing a purchase.

Any agreement concerning payment, inspection, transfer of ownership or other conditions of sale is made directly between the buyer and seller. IslandAutoBids is not a party to that agreement.

6. Prohibited Activities

• Offer manipulation or shill offering
• Listing stolen or illegally obtained vehicles
• Harassment or abusive behaviour toward other users

IslandAutoBids reserves the right to cancel listings, remove users or take other appropriate action in cases of fraud, policy violations, suspicious activity or any other reason deemed necessary to protect the platform and its users.

7. Content and Intellectual Property

You retain ownership of all content you submit to IslandAutoBids, including photos, descriptions and other listing materials.

By submitting content to the platform, you grant IslandAutoBids a non-exclusive, royalty-free licence to:

• Display your content on the platform as part of your listing
• Feature your listing in paid promotional placements, including Spotlight and Homepage Feature placements, that you have purchased
• Share or promote your listing on IslandAutoBids social-media channels, advertisements and marketing materials
• Retain your listing and its content on the platform after it has ended, as part of our public listing archive

This licence is limited to operating, promoting, and improving the IslandAutoBids platform. We will not sell your content to third parties or use it for purposes unrelated to the platform.

You represent that you have the right to submit all content you upload and that it does not infringe any third party's intellectual-property rights.

8. Disclaimers and Limitation of Liability

Vehicle listings and related information are provided by users. IslandAutoBids does not guarantee the accuracy, completeness or reliability of that information or the ownership, condition, mileage, history, legality, safety, roadworthiness or value of any listed vehicle.

IslandAutoBids does not guarantee that a buyer or seller will complete a transaction or comply with any agreement made between them.

The IslandAutoBids platform is provided on an “as available” basis. Although we aim to provide a reliable service, we do not guarantee that the platform will always be uninterrupted, error-free or available without delay.

To the fullest extent permitted by law, IslandAutoBids will not be responsible for loss or damage arising from:

• inaccurate, incomplete or misleading information provided by a user;
• the condition, ownership, legality, safety or roadworthiness of a listed vehicle;
• fraud, misrepresentation, non-payment or other conduct by a buyer or seller;
• a transaction or dispute between users;
• a user’s reliance on listing information without carrying out appropriate checks; or
• temporary interruptions or technical issues affecting the platform.

To the fullest extent permitted by law, IslandAutoBids will not be liable for indirect or consequential losses, including loss of profit, opportunity, business or data.

Where IslandAutoBids is legally responsible for a direct loss arising solely from a paid promotional service, and that responsibility may lawfully be limited, our total liability for that service will not exceed the amount paid for the affected promotion.

Nothing in these Terms excludes or limits any consumer right or liability that cannot lawfully be excluded or limited, including liability for fraud or wilful misconduct by IslandAutoBids.

9. Governing Law

These Terms and any dispute arising from the use of IslandAutoBids are governed by the laws of the Republic of Seychelles.
